Terms of Service

1. Agreement to these terms
By creating an account or using the Relay platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accessing Relay on behalf of a school or organisation, you represent that you have authority to bind that organisation to these Terms.
These Terms form a legally binding agreement between you and Backpedal Pty Ltd (ABN 88 152 435 286), trading as Relay Tech ("Relay", "we", "us"), a company incorporated in Queensland, Australia. If you do not agree to these Terms, do not use the Service.
2. Description of service
Relay is a relief teacher management platform for Australian schools. It enables school deputies and administrators to manage leave requests and coordinate relief teacher coverage; permanent staff to submit leave requests and upload lesson plans; and relief teachers to view and apply for available positions at schools where they are registered.
Relay is a tool for coordination — it does not employ relief teachers, guarantee job placements, or guarantee that leave requests will be covered.
3. Accounts and access
Relay accounts are provisioned at the school level. Access is granted either by self-registration (where your email domain matches a registered school) or by invitation from a school administrator. All self-registered accounts are subject to approval by the school's deputy administrator before access is granted.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@relay.au if you suspect any unauthorised use of your account.
One person may not maintain more than one active account. Accounts are not transferable.
4. Acceptable use
You agree not to use the Service to:
— Provide false or misleading information during registration or in any communication through the platform.
— Access another user's account or data without authorisation.
— Attempt to circumvent, disable, or interfere with any security feature of the platform.
— Use automated scripts, bots, or scraping tools to access, collect, or manipulate data from the Service.
— Post or transmit content that is unlawful, defamatory, discriminatory, or that violates any applicable law or regulation.
— Use the Service for any purpose other than the management of relief teacher staffing at Australian schools.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Data ownership
All data submitted through the Relay platform — including leave requests, job postings, assignment records, and uploaded lesson plans — remains the property of the school or organisation on whose behalf it was submitted.
Relay processes this data to provide the Service and does not claim ownership of any content you or your organisation submits. You grant Relay a limited, non-exclusive licence to store, process, and display this data solely as necessary to operate the Service.
6. Intellectual property
The Relay platform, including its software, design, user interface, trademarks, and documentation, is owned by Backpedal Pty Ltd (ABN 88 152 435 286), trading as Relay Tech, and protected by Australian and international intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in the Relay platform beyond the limited licence to use the Service as described herein.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Relay, you consent to the collection, use, and disclosure of your personal information as described in that policy.
All personal information is stored in Australia (AWS ap-southeast-2, Sydney region) in accordance with Australian data sovereignty requirements.
8. Availability and modifications
We aim to provide a reliable and available service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. Where a change is material, we will provide reasonable notice to registered users.
9. Disclaimer of warranties
To the maximum extent permitted by applicable Australian law, the Service is provided "as is" and "as available" without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Relay does not warrant that the Service will be error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.
10. Limitation of liability
To the maximum extent permitted by law, Backpedal Pty Ltd (ABN 88 152 435 286), trading as Relay Tech, and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100 AUD, whichever is greater.
Nothing in these Terms limits or excludes any guarantee, warranty, right, or remedy that cannot be excluded or limited under the Australian Consumer Law.
11. Termination
You may close your account at any time from within the platform settings. Account closure takes effect immediately; your authentication access is revoked and your personal information is handled in accordance with our Privacy Policy.
Relay may suspend or terminate your access to the Service at any time for breach of these Terms, or if we believe your use poses a risk to other users or to the platform. We will endeavour to give you reasonable notice unless the breach is serious or immediate.
12. Governing law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
13. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify registered users by email where practicable. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
